Terms of Use

Article 1 - About this Agreement

  • These terms of use (hereinafter referred to as the "Terms of Use, Agreement") are established by Seekers, which apply to all actions taken by Seekers.
  • This Agreement sets forth the terms and conditions of use of the System. The person using this System (hereinafter referred to as "User") shall use this System in accordance with these Terms of Use.
  • By using the System in any way, the User shall be deemed to have agreed to all of the contents of these Terms of Use.
  • Seekers stipulates the Terms of Use of this System in these Terms of Use and other terms of use. The other terms of use shall constitute a part of the Terms of Use regardless of the name.
  • In the event that the provisions of these Terms of Use differ from the provisions of the other terms of use, in question shall take precedence.
  • If there is a provision in these Terms of Use that is not currently applicable to the User, it shall be applied from the time it becomes applicable in the future due to a change in circumstances.

Article 2 - Definition

The terms used in this Agreement are defined as follows.

  • Seekers: Our company, Seekers, is the umbrella term for our Seekers website, app, and social media system for job seekers, employers, and recruiters, and the company that develops and operates it.
  • System: A generic term for a system for job seekers, employers and recruiters that enables job matching through the Company's website, app and social media.
  • Member: A person who has registered through the System.
  • User: Job seekers using this System.
  • Employer: An entity that uses this System for the purpose of hiring job seekers.
  • Recruiter: A person who searches for job seekers for specific jobs, obtains their consent and uploads their information through the System.
  • Premium Member: A member who has special functions and privileges provided in addition to the functions and privileges available to regular members.
  • Premium Function, Premium Feature, Premium Membership: Special features and privileges in addition to those available to regular members.
  • Subscription Term, Subscription Period: Duration of Premium Membership.

Article 3 - Membership registration application

  • Those who wish to become a Member of Seekers (hereinafter referred to as "Registration Applicant") are required to agree to these Terms of Use.
  • Any person who applies for Membership registration or a job through Seekers shall become a Member of Seekers.
  • If any changes are made to the information provided at the time of registration, the User shall immediately correct the information on this System.

Article 4 - Refusal to accept a Membership application

If the Registration Applicant falls under any of the following items, Seekers may, at its discretion, refuse to accept an application:

  • If the Registration Applicant has violated these Terms of Use or any other terms of use in the past.
  • When the Registration Applicant is a member of an antisocial force or its related parties.
  • Any other case that we deem to be inappropriate.

Article 5 - Cancellation of Membership

If you wish to cancel your Membership, you shall request Seekers to cancel your registration in the manner prescribed by Seekers.

Seekers may, at its discretion, forcibly terminate the registration of Users and refuse to allow them to use this System if they commit any of the following acts:

  • If you violate this Agreement or any other terms of use.
  • If you have not logged in to the System for more than one year after registration.
  • Any other case that Seekers deems inappropriate.

Article 6 - Possession of a Membership account

  • You shall have one (1) member account per person, and no one person may hold more than one (1) member account, and no two (2) people may hold one (1) member account jointly.
  • The User may not, under any circumstances, transfer or lend his or her member account to a third party.
  • The provisions of Paragraphs 1 and 2 of this Article do not apply to those otherwise permitted by Seekers.

Article 7 - Usage Fees

  • There is no charge to register as a Member of Seekers and to use the System functions within the scope of this System as determined by Seekers.
  • The use of the Premium Functions defined by Seekers is subject to a fee. The specific charge amount of the Premium Features (hereinafter referred to as "Fees") shall be displayed on the System in a way that is recognizable to Members.
  • On the start date of the Subscription Term, you are obligated to pay the Fees. However, this does not apply in cases where Seekers recognizes otherwise.

Article 8 - Application for Premium Membership registration

  • Those who wish to use the Premium functions (including those who wish to use the Free Trial) must register as a Seekers Member and apply for Premium Membership registration to become a Premium Member.
  • The person applying for Premium Membership (hereinafter referred to as the "Premium Membership Applicant") shall register the information specified by Seekers and select the payment method and the period of subscription to the extent displayed by Seekers on the application screen on the System.
  • A Premium Membership Applicant becomes a Premium Member upon acceptance of the application for Premium Membership.
  • If any changes occur to credit card information or other Premium Membership registration information, the Premium Member shall immediately modify the information on this System.

Article 9 - Free Trial of Premium Membership

  • Seekers provides a service that allows Membership holders to use the Premium Membership functions from the start of registration to a certain period of time (hereinafter referred to as the "Free Trial") to be determined by a method that is recognizable to the User on this System. Seekers may offer free use of the Premium functions for a certain period of time from the start of Free Trial registration to the start of the Premium Membership (hereinafter referred to as the "Trial Period"). However, Seekers is not obligated to provide the Free Trial.
  • When applying for a Free Trial registration, the User acknowledges that the registration of a credit card and other procedures that Seekers indicates on the application screen on the System are required. However, this is not limited to the case where Seekers determines otherwise.
  • If the User does not complete the cancellation procedure in the method prescribed by Seekers by the day before the Trial Period expires, Seekers will assume that there is an agreement to renew the registration for the course period selected by the User at the time of the application for the Premium Membership registration from the day after the Trial Period expires, and the User will pay the relevant usage fee. However, we may not renew the subscription for any reason and may terminate it on the expiration date of the Trial Period. However, Seekers may not renew the registration for any reason and may terminate the registration on the expiration date of the Trial Period.

Article 10 - Non-acceptance of Premium Membership registration

Seekers may, at its discretion, refuse to accept an application for use of the Premium Membership registration in any of the following cases.

  • When the Premium Membership registration applicant has applied for Premium Membership registration without following the method described in Article 9.
  • If the applicant has violated these Terms of Use or any other terms of use in the past and was subject to compulsory registration cancellation.
  • Any other case that Seekers deems to be inappropriate.

Article 11 - Termination of Premium Membership by Seekers

Seekers may, at its discretion, forcibly cancel the registration of a Premium Membership and refuse to allow the Member to use the Premium Function if any of the following events occur:

  • If it becomes clear that the application for Premium Membership was made without following the methods described in Article 9.
  • In the event that the payment of Fees or other liabilities is delayed beyond the due date.
  • If the User's use of the credit card or other payment method that the user registered as a means of payment is suspended for some reason.
  • If you violate these Terms of Use or any other terms of use.
  • If your Premium Membership registration is forcibly cancelled.
  • Any other case that Seekers deems inappropriate.

If a Premium Member ceases to be a member of Seekers due to cancellation of registration, termination, or any other reason, the Premium Membership will naturally end.

Article 12 - Termination of Premium Membership by Users

If a Premium Member wishes to cancel their Premium Membership, they must log in to the system and submit a request to Seekers using the method prescribed by Seekers. However, if the User does not complete the procedures normally required by Seekers by the day before the Subscription Period expires, the Premium Membership will be renewed for the same Subscription Period and under the same conditions from the day after the Subscription Period expires, and Seekers will treat this request as an offer to take effect at the end of the renewed Subscription Period.

Article 13 - Maintenance of access environment

  • The User shall, at his/her own responsibility and expense, be responsible for the proper maintenance of personal computers and any other equipment, software, and means of communication necessary for the use of this System.
  • Users shall take security measures to prevent unauthorized access and information leakage according to their usage environment.
  • Seekers shall not be involved in, and shall not be responsible for, the User's usage environment.

Article 14 - Management of account Credentials

  • In the event that Seekers grants a User this System, or allows the User to set this System, the User shall be responsible for managing the password, member ID, registered email address, etc. (hereinafter collectively referred to as "Credentials").
  • The User shall not allow a third party to use, lend, transfer, sell, or pledge their Credentials to a third party for the purpose of using the System while they are in their Membership status.
  • The User shall be responsible for any damage caused by inadequate management of Credentials, errors in use, use by a third party, and Seekers shall not be liable for any damage.
  • In the event that a third party learns of your Credentials, if there is a risk that a third party will use your Credentials, you shall immediately notify us of that fact, and if there are instructions from us, you shall comply with them.

Article 15 - Accuracy of registered working history

  • After becoming a Member of Seekers, you are responsible for posting your resume through this System at your own discretion and at your own risk, within the scope of the posting criteria set by Seekers.
  • Users may not write other people's personal information (address, email address, telephone number, etc.) on their Curriculum Vitae without making a consent, and if such information is included in their Curriculum Vitae, Seekers may delete or modify the relevant section.
  • When a User submits a Curriculum Vitae, Seekers shall review the contents of the Curriculum Vitae to see if they meet the criteria for inclusion in the resume, and only if they meet the criteria for inclusion shall the resume be made available to Employers.
  • Users shall immediately revise their Curriculum Vitae as soon as the content of their resume is changed.
  • We reserve the right to request the voluntary deletion or amendment of your Curriculum Vitae if it is found to be contrary to the standards of publication or to be inaccurate, to change the scope of publication of your Curriculum Vitae, or to make your curriculum vitae unviewable (non-public), or to delete or change all or part of the registered information without prior notice.

Article 16 - Guarantee

Users who post information such as a Curriculum Vitae shall warrant to Seekers that the information is truthful and accurate and that the information does not infringe on the rights of a third party. In the unlikely event of a dispute with a third party, the User shall resolve the problem at his or her own expense and responsibility and shall not cause any trouble or damage to Seekers.

Article 17 - Granting of rights regarding this System

  • Permissions from Seekers to Users
    • Seekers shall permit the User to use this System within the scope defined by Seekers.
    • Seekers has the rights to all content provided by this System, and Seekers does not grant Users any license to use or implement any patents, utility model rights, design rights, trademarks, copyrights, entitled know-how or other intellectual property rights (hereinafter referred to as "Intellectual Property Rights") owned by Seekers.
    • The User shall not reproduce, transmit, transfer, lend, translate, adapt or otherwise use the contents of this System by any means.
    • Seekers shall not grant sublicensing rights to the User for this System.
    • The use of this System which Seekers grants to the User shall be non-exclusive.
    • Notwithstanding the preceding paragraph, in the event that the User loses User qualification regardless of cancellation of registration or any other reason, the right to use this System granted to the User by Seekers shall be extinguished.
    • Seekers may change the period of validity of the right to use this System granted to the User at any time.
    • In the event that User loses User qualification regardless of cancellation of registration or any other reason, Seekers shall, in conjunction with the extinction of the right to use this System, except in cases where Seekers treats it separately, all profits relating to this System shall also be extinguished.
  • Permission from Users to Seekers
    • The copyright of information such as Curriculum Vitae belongs to the User who created it.
    • Seekers shall use or license the information on your Curriculum Vitae to the extent necessary for the operation and smooth provision of this System, advertising and promotion of this System, advertising and promotion of third party products or services in relation to this System, construction, improvement, maintenance, and improvement of this System. When using information such as a work history, you may omit to indicate some of the information or your name. When using information such as work history, it shall be possible to omit part of the information or the display of the name.
    • Seekers shall be able to provide users with notices of new system functions, distribution of advertisements, distribution of mail magazines, administrative contact on the operation of this System, and other information.
    • Notwithstanding the preceding paragraph, in the event that the User notifies Seekers beforehand or after the fact by the method prescribed by Seekers to the effect that they do not wish to receive such information, Seekers shall not provide such information except in cases where it is necessary to provide this System. In the event that an error notice is received more than a certain number of times, or if a third party complains, regardless of the User's wish to provide information, Seekers may delete the User's email address from the email distribution destination.
    • Seekers may use provided information to create numbers, statistical data in a format that does not identify individual Users, and may use said statistical data without any restriction (including but not limited to proposals to Employers and market research).

Article 18 - Implementation of questionnaires

  • Seekers may conduct questionnaires and surveys regarding the use of this System and its services, including the status of applications, job offers, and job changes, at the time of User's Membership in Seekers or after User is no longer a Seekers member.
  • In the case of the preceding paragraph, the User shall provide information and opinions based on their own responsibility, and shall guarantee the truthfulness and accuracy of the information and opinions they provide to Seekers.

Article 19 - Prohibited matters of the User

The User shall not perform any of the following acts in connection with the provision of this System. The User shall bear the responsibility to compensate Seekers for any and all damages caused by such acts, and Seekers may take all legal measures, both civil and criminal.

  • Prohibited matters regarding information such as work history and its upload
    • Uploading content that is difficult to verify the authenticity or false content in a work history or other information that is false.
    • Uploading information on your work history that is or may be offensive to public order and morals.
    • Uploading any other information on your work history that is deemed inappropriate by Seekers.
  • Other general prohibitions
    • Forwarding email containing information about job offers to any other persons.
    • In addition to the preceding item, disclosing to a third party information such as job offers and other information obtained through the System or an Employer that is addressed to the individual.
    • An act that prevents or may prevent the collection of Fees or other debts.
    • Actions that infringe or may infringe on the copyrights, portrait rights or other intellectual property rights of Seekers or others.
    • Any act that infringes or may infringe on the property, privacy or image rights of Seekers or others.
    • Any act that unfairly discriminates against or defames Seekers or others, promotes unfair discrimination against others, or damages their honor or credibility.
    • Using this System by claiming to be someone other than yourself, pretending to have authority to represent or represent someone else, or falsely claiming to be in partnership or cooperation with another person or organization.
    • Actions that Seekers deems to be contrary to laws and regulations, public order and morals, or these Terms and Conditions, or that may be deemed to be so.
    • Actions that Seekers deems to infringe on the rights of Seekers or others, or to have the potential to do so.
    • Using the System for the purpose of sexual intercourse, indecent acts, or encounters which are not related to recruitment activities.
    • Any act that interferes with Seekers business operations.
    • Any action that may damage the reputation of Seekers or this System.
    • Use of information obtained through this System beyond the scope of personal use such as reproduction, sale, publication or other private use.
    • Accessing or attempting to access System authentication and security, non-public information or accounts on the System without legitimate authorization.
    • Any action that burdens Seekers or any other person's server, or any action that interferes with or may interfere with the operation of the System or network system, or any action that may do so.
    • Other acts that are prohibited by Seekers.

Article 20 - Compensation for damages

If the User has violated these Terms and Conditions, and has caused damage to Seekers, the User, to Employers, the obligation to compensate for any direct or indirect damage.

Article 21 - Disclaimers

  • Users shall use this System at their own risk, and Seekers shall not be held responsible for any action taken by them or any result thereof.
  • Seekers does not guarantee the legality, morality, reliability, or accuracy of the information such as job offers and other information obtained by Users through this System, as well as the words, actions, and behaviors of job seekers and Employers. Users acknowledge this and use the System at their own risk.
  • Seekers shall not be involved in the mediation of individual employment contracts and disputes arising from such contracts in relation to job information.
  • Seekers does not guarantee that this System is free of technical inaccuracies, typographical errors, or misprints, or that it will not cause defects or failures.
  • Seekers does not manage and operate any external sites linked to the information provided by this System, and Seekers assumes no responsibility for the legality, morality, reliability, or accuracy of their contents, or for changes or updates to the sites. The fact that external sites are linked to the information provided by this System does not imply that there is any commercial relationship between Seekers and such external sites.
  • Seekers accepts no responsibility for any disputes between Users and Employers, or Employers and other third parties arising from the use of the System.
  • The User agrees that unless there are reasons attributable to Seekers, we will not be liable for any damages caused by or in relation to the following:
    • The User's use of or inability to use this System.
    • The cost of the User's transactions through the System, obtaining information or substituting services.
    • Unauthorized access to or unauthorized modification of the User's transmissions (transmissions) or data
    • Any statements, transmissions (outgoing) or actions by third parties in this System
    • Other matters related to this System and the provision of information from Seekers
  • The User is responsible for the information on his or her Curriculum Vitae and other information. Seekers assumes no responsibility for the legality, morality, reliability, accuracy, or other aspects of the content of the Curriculum Vitae and other information uploaded by Users.
  • If a User defames another person, infringes on the privacy rights of another person, discloses personal information of a third party without permission, commits an act that violates the copyright law, or otherwise violates the rights of another person, the User must resolve the matter at his or her own responsibility and expense, and this company will not be held responsible for any of this.
  • Seekers has the authority to inspect the contents of information such as work history and other information uploaded by Users, but we are under no obligation to do so. In addition, Seekers will not be held responsible for any damage caused by this.
  • The User acknowledges that Seekers has no obligation to store information such as Curriculum Vitae and other information uploaded by Users using this System, and shall take backups of necessary information as appropriate.
  • Seekers has the authority to freely browse and delete files uploaded by Users when it is deemed necessary for the operation of this System, such as when there are circumstances where Users are not using this System appropriately. However, Seekers shall not be obliged to do so. Seekers shall not be held responsible for any damage caused by this.
  • When using this System or information obtained through this System, the user must comply with the regulations of the country or region where the System is used, and Seekers shall not be held responsible for any violation of the regulations by the User.
  • Seekers shall not be responsible for any disputes or other problems arising from the communications and activities of the Users and Employers, or from any communication or transaction between the Users and the Employers or between the Users and the Recruiters. Any dispute between a User and an Employer or between users shall be resolved between the Users concerned.
  • Users agree that we may add or change the functions of the System at our discretion and that we may interrupt or terminate the System due to unavoidable circumstances.
  • In the event that Seekers deems that there are reasonable grounds to believe that an act in violation of these Terms of Use or other Terms of Use has been or may be in violation of these Terms of Use, Seekers may forcibly terminate the registration of the User who has committed such an act, delete all or part of the information on his or her Curriculum Vitae, or change the scope of disclosure, but Seekers shall not be liable for any damages caused by such actions.
  • Even if Seekers acts on behalf of a User to enter information such as a resume and other information by email or verbally, our responsibility is limited to the case where the information entered differs from the information requested by the User via email or verbally due to our intentional or gross negligence.
  • Seekers shall not be held responsible for any event such as an announcement of a meeting outside of this System by a User to gather together with other Users and to gather a wide range of participants.
  • All transactions (including participation in promotions such as sweepstakes) with advertisers advertising (including sweepstakes advertisements) or promoting their products through the System are the responsibility of the User and the advertiser, and the user and the advertiser shall be responsible for payment for the products, determination of the terms and conditions of the agreement, guarantees, and any liability for security. This means that Seekers will not be liable for any loss or damage caused by the transactions carried out by the advertisements in this System. Seekers shall not be liable for any damage resulting from transactions caused by the advertisements posted in this System or from the fact that the advertisements were posted.
  • Seekers shall not be liable for classifying members based on the information registered by the user, nor shall Seekers be liable for any change in the user's membership classification at the discretion of the Company.

Article 22 - Non-Refunding of Fees

  • Seekers will not give a prorated refund in the event that the Premium Membership is terminated or for any other reason during the course period. However, this does not apply in the event that the Premium Membership is terminated due to the intentional or gross negligence of the Company.
  • In addition to the preceding paragraph, Seekers will not refund the Fees received for any reason. However, this does not apply in cases where the Company recognizes otherwise.

Article 23 - Dealing with violations

  • If the User is deemed to have violated these Terms of Use or any other terms of use, or if Seekers deems it necessary, Seekers may take the following actions against the User in question. However, Seekers shall have no obligation to do so. In addition, Seekers will not be held responsible for any disadvantage or damage caused to the User as a result of these measures.
    • To stop any act that violates these Terms of Use or any other terms of use, and to demand that a similar act not be repeated.
    • Voluntarily requesting deletion or correction of information in a Curriculum Vitae.
    • Deleting all or part of the information in the Curriculum Vitae, changing the scope of disclosure, or making it unavailable to the public.
    • Encouraging Employers to discourage Users from applying for jobs, making inquiries, or scouting out jobs for said Users.
    • Disclosing violations within or outside of this System, including reporting to the police or other public authorities in cases that may be criminal, administrative or otherwise relevant.
    • Suspend the use of all or part of the System
    • Termination of the Membership of Seekers.
    • Termination of the Premium Membership.
    • Not to accept the application for use of Seekers.
    • Not to accept the application for the Premium Membership.
  • Users may not object to Seekers actions in violation of these Terms of Use or any other terms of use based on these terms.
  • If a User causes damage to Seekers, regardless of whether or not the company has taken the measures described in paragraph 2, the company can make a claim for compensation against that User.
  • Seekers will not be held responsible for any consequences resulting from any violation of these Terms of Use or any other terms of use, and will not refund any Fees.

Article 24 - Changes to System Functions

Seekers shall be able to change, suspend or terminate all or part of the functions of this System without prior notice to the User for any reason whatsoever.

Article 25 - Modification of this Agreement

  • Seekers may, at its discretion, change these Terms of Use at any time for any reason without the prior approval of the User.
  • Unless otherwise specified by Seekers, the amended Terms of Use shall take effect from the time Seekers displays them on the System.
  • By using the System after any changes to these Terms of Use, you will be deemed to have accepted all of the contents of the amended Terms of Use.
  • In the event that the Terms of Use are newly established or changed, the user's Curriculum Vitae and other information uploaded prior to such establishment or change shall also be applied to the Terms of Use.

Article 26 - Suspension of use for maintenance

  • Seekers may temporarily suspend the operation of the System without prior notice or consent of the User in the following cases, and the User agrees to this in advance.
    • To maintain the System or the server associated with the System or the Employer’s System, or to change the specifications of the System or the Recruiter's System or to repair any defects in the System.
    • In the event of a natural disaster or other emergency, or if the operation of this System becomes difficult or impossible due to the threat of an outbreak or the amendment or enactment of laws and regulations.
    • In the event that Seekers deems it necessary to suspend the System temporarily for other unavoidable reasons.
  • Seekers shall not be responsible for any damage to Users or third parties caused by the cessation of the operation of this system as specified in the preceding paragraph, and shall not refund any usage fees.

Article 27 - Deletion of information after cancellation of membership

You acknowledge that if you are no longer a member of Seekers for reasons such as cancellation of Membership or otherwise, all information on your resume and history will be deleted and you will no longer be able to check the contents of your resume or other information on this System. However, Seekers is not obligated to delete such information.

Article 28 - Use of attribute data

  • Seekers may use cookies, JavaScript, and other technologies to collect information provided at the time of Membership registration such as age, gender, occupation, region of residence, and other attribute information that cannot be used to identify an individual (even when combined, this is limited to information that cannot be used to identify an individual), as well as information about the User's activities within the site. However, cookies and activity history do not contain any personal information.
  • Seekers may use information that cannot identify individuals, such as attribute information and behavioral history obtained in the preceding paragraph, without any restrictions.

Article 29 - Supplementary provisions

This agreement is effective 18th March 2021

This page states the terms of use (“Terms”) under which you (“You”) may use this website, and your relationship with Seekers Technology Sdn. Bhd. (“Seekers.my”, “we” or “us”). Please read them carefully as they affect Your rights and liabilities under the law. If You do not agree to these Terms, please do not register for or use Seekers.my. These Terms are effective as of 05-January-2021. If You have any questions on the Terms, please contact us.

1. Terms and Conditions

Seekers.my is provided to you for your use subject to these Terms. You agree to bind with these terms and conditions when you start to use Seekers.my. You agree to use Seekers.my at your own risk. These terms and conditions will prevail if any conflict happened between Seekers.my and you.

Seekers.my reserves the right to update these terms and conditions from time to time for legal or regulatory reasons in order to smoothen the operation of Seekers.my. You will be notified via the email address provided by you on registration or via a suitable announcement on Seekers.my. The changes will apply to the use of Seekers.my after we have given you notice. If you do not wish to accept the new terms and conditions, you should not continue to use Seekers.my.

2. Definitions

Employer” means a person or entity who recruits or hires through Seekers.my.

Candidate” means a person whose individual profiles or information which are uploaded to Seekers.my.

Content” means all information, including number, text, photographs, graphics, video, infographic, audio, advertisements, messages or other materials submitted, posted or displayed by Employer on or through Seekers.my.

Seekers.my Services” means the services provided by Seekers.my including but not limited to:-

  • - the provision of recruitment consultation services;
  • - the provision of recruitment management tool Seekers Recruitment System (“SRS”);
  • - the provision of Candidate sourcing services;
  • - the provision of interview setting supports;
  • - the provision of offer negotiation assistances;

3. Signing up on Seekers.my

To register on Seekers.my, you must be 18 years of age or above, and you must provide the valid company name, registration number, address, email and contact number. You are responsible to provide additional information if necessary.

Seekers.my shall be responsible in preserving the information provided by you in a safe manner. You are responsible and must ensure that the details provided by you on registration or at any time are correct and complete. We reserve the rights to examine from time-to-time, some or all information provided by you.

You are responsible and must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.

If you breach any of the obligations under these Terms and Conditions, we reserve the rights to suspend or cancel your account immediately in our sole discretion. You have to bear all the losses and damages.

4. Password and security of Seekers.my

When you register to use the Seekers.my, you will be asked to create a password. You must keep this password confidential and ensure this is not disclosed or shared with anyone. If you suspect or notice that someone else knows your password you should immediately notify us by contacting us.

If Seekers.my has reason to believe that there is likely to be a breach of security or misuse of the Seekers.my, we may require you to change your password or we may suspend your account immediately.

If you lost your Password or misuse other than recruitment activity, you are responsible to bear all the losses and damages.

5. Availability, error and inaccuracy of Seekers.my

Although Seekers.my always strives to give the best to Employers, Seekers.my has no obligation to provide services which completely meet your requirements or expectations.

We cannot guarantee that any of the content in Seekers.my is the latest. Seekers.my will update the content from time to time to ensure our quality of service.

We cannot guarantee that Seekers.my will be error-free. You are responsible to report to us immediately if you find Seekers.my performs unusually.

Your access may be restricted from time to time for our regular repairs, maintenance, update of new content and services.

6. Usage of Seekers.my

Seekers.my is provided to Employers to recruit suitable Candidates.

Your use of the Seekers.my Services is also subject to any other contracts you may have with Seekers.my. In the case of any conflict between these Terms and any contract you have with Seekers.my, these Terms will prevail.

You are granted a limited, terminable, non-exclusive right to access and use Seekers.my only for your recruitment purposes.

You are fully responsible for securing your login credential to Seekers.my.

You are not allowed to violate the security of Seekers.my.

You are not allowed to share any content, including texts or graphics, which are unlawful, harassing, threatening, harmful, sexually-related or any other negative terms on Seekers.my. You are not allowed to include the name, logo or trademark of any scammed companies.

You are not allowed to copy or duplicate any content, including texts or graphics, for other purposes, except recruitment.

You are not allowed to share any content which involves political issues.

You are not allowed to share any scam or misleading information, in any form including texts or graphics.

You are not allowed to share any content that promotes the occurrence of illegal activities, criminal offences, including but not limited to selling or buying weapons, which breaks Malaysia Law.

You are not allowed to advertise or promote other products or services, except recruitment.

You are not allowed to carry out any activity or action, including block the access, which affects or interferes with any other person’s use of Seekers.my.

You should not share anything which is related to multi-level marketing, franchise or any other sales-related advertisement.

You should not make any unauthorized commercial use of Seekers.my. Seekers.my reserves the right to terminate your account immediately in our sole discretion.

You should not request Candidates to pay deposits, placement fees, processing fees or any other similar fees, directly or indirectly, and/or require Candidates to make purchases.

You should not advertise more than 1 job position in each job posting, unless this is permitted by Seekers.my.

Seekers.my reserves the right to remove unnecessary content or eventually terminate your access to Seekers.my Website without giving prior notice.

The violations and misuse of network security may result in civil and/or criminal liability. Seekers.my will investigate the occurrences of violation of network security which may lead to civil or criminal liability.

Seekers.my may terminate your use of the Seekers.my Services and in such event, any payment or deposit made by you shall be forfeited.

You understand and acknowledge that if you cancel your Employer account or your Employer account is terminated, all your account information from Seekers.my, including saved resumes and contacts, will be deleted from Seekers.my Databases. You are not allowed to backup such data or information without Seekers.my’s permission.

7. Submission of contents to Seekers.my

You understand and acknowledge that all information provided or confirmed by you, shall be stored in Seekers.my’s database, and may be transferred to countries outside of your location for the purposes of storing and/or processing.

By submitting, posting or displaying Content on or through Seekers.my, you grant Seekers.my to distribute and publish such Content through Seekers.my. Seekers.my reserves the right to reject any Content in its sole discretion without giving prior notice.

You are required to allow users to access the content for any type of use, if you post the content in any public area of Seekers.my.

Seekers.my has the right to permanently delete or remove the Content, if Seekers.my find such Content violates privacy policy, rules and regulations and Malaysia Law.

Seekers.my reserves the right to remove accounts and prevent their further access to the Seekers.my and/or use of Seekers.my for violating the Terms or applicable laws, rules or regulations.

Seekers.my has no obligation to maintain or guarantee the accuracy, reliability or truthfulness of the Content. You agree and acknowledge that any trust on this Content posted by other users will be at your own risk.

8. Payment of fees

All amounts owed to Seekers.my must be paid within the specified payment terms from the date of the invoice.

Seekers.my may charge interest at 8% per annum on any late payment.

9. Seekers.my’s right to suspend or cancel your registration

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms.

You can cancel your registration at any time by informing us. If you do so, you must stop using Seekers.my.

The suspension or cancellation of your registration and your right to use the Seekers.my shall not affect either party’s statutory rights or liabilities.

10. Term and Termination

These Terms will remain in full force and effect while you are a user of any Seekers.my’s services.

Seekers.my reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of your User Content from Seekers.my and immediate termination of your registration with or ability to access Seekers.my and/or any other services provided to you by Seekers.my, upon any breach by you of these Terms or if Seekers.my is unable to verify or authenticate any information you submit to a Seekers.my registration.

Even after you are no longer a User of the Seekers.my, certain provisions of these Terms will remain in effect.

11. Seekers.my’s Liability

Seekers.my act as a site for:

  • - Employers to post job vacancies
  • - Employers to collect Candidate’s information
  • - Employers to manage recruitment process
  • - Employers to analyze the performance of the job posts

Seekers.my is not responsible for the accuracy, quality, safety or legality of the Content, and the ability of Employers to offer job opportunities to candidates or the ability of candidates to fill job vacancies.

The Seekers.my also provides content from other internet sites or resources.

The use of all Seekers.my and the Seekers.my's content is at your own risk.

Nothing on Seekers.my shall be considered an representation or warranty with respect to anyone including third parties, whether in regards to its web sites content, products, services, hiring, experience, employment or recruiting practices or otherwise.

If we are in breach of these Terms, we will only be responsible for any losses that you suffer as a direct result and to the extent that they are a foreseeable consequence to both of us at the time you use the Seekers.my.

Our liability shall not, in any event, include business losses such as lost data, lost profits, or business interruption.

Upon signing the terms and conditions, the Employer agrees and understands the terms of use which shall be valid for a period of 365 days from the date of your acceptance.

As for PDPA(Personal Data Protection Act 2010 (Act), we agree and undertakes that it shall comply with the provisions of the PDPA 2010(Act) and its regulations, by-laws, codes of practice and any regulations pertaining to the requirement of the Act that may be issued from time to time, in connection with any obligations under this engagement which requires it to process the personal data.

We hereby warrant to the Employer that it has obtained the consent (including explicit consent for any sensitive data) from the Candidate for it to process the personal data and transfer the same to the Employer.

12. Disclaimers

Seekers.my shall not be liable for any loss of information caused as a result of any interruption, or any damages that are caused by the Candidate.

We shall not be liable for suspension or termination of Seekers.my services or Seekers.my content, accuracy, or quality of information available or transmitted through Seekers.my services. You acknowledge and agree that it is not Seekers.my's policy to exercise editorial control over and to edit or amend any data or contents of any emails or posting or any information that may be inserted or made available or transmitted to or from a third party in or through Seekers.my and/or Seekers.my Services.

The Terms and Use shall be governed by and construed in accordance with the laws of Malaysia, and the parties shall submit to the non-exclusive jurisdiction of the courts of Malaysia. As a convenience, Seekers.my includes Third Party Website which links to Employer websites or material which are beyond its control. We are not responsible for content on any site outside the Seekers.my.

13. Indemnity

You agree to defend, indemnify, and hold harmless Seekers.my and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from:-

Any Content or other material you provide to any Seekers.my Services;

Your use of any Seekers.my Content; or

Your breach of these Terms.

Seekers.my shall provide notice to you promptly of any such claim, suit, or proceeding.

14. Refund

Any refund of payment made to Seekers.my shall be at the sole discretion of Seekers.my.

15. Applicable Law

These Terms will be subject to the laws of Malaysia.

We will make an effort to solve any disagreements efficiently. Should you not be satisfied with the way we deal with any disagreement and you want to take court proceedings, you must do so within Malaysia.

16. International Use

We make no promise that materials on the Seekers.my are appropriate or available for use outside of Malaysia. Accessing the Seekers.my from territories where its contents are illegal or unlawful is prohibited. If you choose to access this Seekers.my from outside Malaysia, you do so on your own initiative and you are responsible for compliance with your respective local laws.

17. Miscellaneous

You may not transfer any of your rights under these Terms to any other person. We may transfer our rights under these Terms to another business where we reasonably believe your rights will not be affected.

If you breach these Terms and Seekers.my chooses to ignore this, Seekers.my will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms.

We shall not be responsible for any breach of these Terms caused by circumstances beyond its reasonable control.

If any of these Terms shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and all provision not affected by such invalidity, or unenforceability shall remain in full force and effect.

18. General

Seekers.my is operated by an owned company Seekers Technology Sdn. Bhd., and the subsidiary of JTK C License holding entity Agensi Pekerjaan Job Search Asia Sdn. Bhd.

19. Extended support for the boost function

If Employer is unable to obtain the relevant candidate information after one week of using the Boost function, Seekers.my may provide extended support. However, the decision of whether or not to provide such support lies solely with Seekers.my.

When recruiting using the Boost function provided by Seekers.my, jobs that meet the following conditions are not eligible for extended support by the administrator:

  • jobs that include job requirements for Chinese speakers only
  • jobs with a monthly salary exceeding RM5,000
  • jobs related to insurance sales

The administrator will check the original job requirements to determine the validity of the relevant candidate and will not offer extended support if the relevant candidate is identified.
